1. About this policy
Haverford Brands Pty Ltd (ABN 50 000 022 551) trading as Just Pro Tools ("we", "us" or "our") is bound by the Privacy Act 1988 (Cth) ("Privacy Act") and the Australian Privacy Principles in Schedule 1 to the Privacy Act ("APPs"). This policy explains how we collect, hold, use and disclose personal information, and how you may access or correct that information or make a complaint. In this policy, personal information has the meaning given in section 6 of the Privacy Act.
2. What we collect
The kinds of personal information we collect and hold include:
- Contact and order details. Your name, delivery and billing address, email address and phone number, what you have bought, and your order history.
- Account details. Your login details where you create an account, and your saved preferences.
- Your dealings with us. Emails, live chat, social media messages and phone enquiries, including any attachments you send us, and records of warranty and return requests.
- Tracking information and proof of delivery from our carriers, and any access or site instructions you give us.
- Website and device information. Your IP address, device and browser information, cookie and advertising identifiers, the approximate location indicated by your IP address, the pages you visit and how you interact with them, including website session recordings.
- Marketing information. Your marketing preferences, records of the consent you gave and when, and your unsubscribe or suppression status.
- Reviews. The content of any review you leave and the name or profile details you submit with it.
- Payment and fraud information. Records of your payments, and the risk information our ecommerce platform generates when assessing an order for signs of fraud.
We do not seek to collect sensitive information as defined in section 6 of the Privacy Act. If you provide us with unsolicited sensitive information, we will deal with it in accordance with APP 4, which includes destroying or de-identifying it where it is lawful and reasonable to do so. We do not store complete payment card numbers; card payments are processed by our payment providers.
If you do not provide the personal information we ask for, we may not be able to process or deliver your order, respond to your enquiry or provide you with an account.
You may browse our website without identifying yourself. Where it is lawful and practicable to do so, you may deal with us anonymously or by using a pseudonym. In most cases, however, we cannot process or deliver an order without your name and delivery details.
3. How we collect it
We collect personal information directly from you when you place an order, create an account, contact us, leave a review, subscribe to marketing or use our website. We also receive information from our payment providers, our ecommerce platform and our carriers in connection with your order, and through cookies and similar technologies when you browse our website.
4. How we hold it
We hold personal information electronically in our ecommerce, customer service, marketing, analytics, inventory and business administration systems. Some information is also held in our email accounts, in our carriers’ systems, and in business records we keep for accounting and tax purposes. Our service providers hold or process this information in Australia and overseas, as described below.
5. Why we collect and use it
• To take, process, deliver and support your order, including arranging freight and handling returns and warranty claims.
• To manage your account and respond to your enquiries.
• To send you marketing about our products, in accordance with section 6 below.
• To detect and prevent fraudulent orders.
• To improve our website and our products, and to understand how customers use them.
• To meet our legal, tax and record-keeping obligations.
6. Direct marketing
We send marketing emails and SMS only to people who have consented to receive them. When you order through our website you can choose whether to receive marketing emails and SMS. Those options are not pre-selected; you must opt in. Placing an order with us does not, of itself, constitute consent to receive marketing.
Every marketing email and SMS we send identifies us as the sender, includes our contact details and contains a functional unsubscribe facility, as required by the Spam Act 2003 (Cth). You may opt out at any time, at no cost, by using the unsubscribe link or reply instruction in any marketing message or by emailing our Privacy Officer. We give effect to unsubscribe requests within five business days, as required by the Spam Act and keep suppression records so that we continue to honour your request.
If you opt out we may still send you messages about your account or an order you have placed, because those are not marketing.
We do not sell personal information.
7. Who we disclose it to and where they are
We disclose personal information to the organisations below, which help us run our business, and only for the purpose for which it was provided to them. Some are located outside Australia or may store information outside Australia.

We also disclose personal information to our professional advisers, and to any person to whom we are required or authorised by law to disclose it. We may disclose personal information if our business or part of it is sold or transferred.
This list is current as at the date of this policy. We review it when we change service providers or platforms.
8. Sending information overseas
As set out in the table above, some recipients are outside Australia, and those recipients may in turn use their own service providers in other countries.
Before we disclose personal information overseas we take such steps as are reasonable in the circumstances to ensure that the recipient does not breach the APPs in relation to that information, as required by APP 8. Subject to the exceptions in the Privacy Act, we may remain accountable for the recipient’s handling of that information under section 16C of the Privacy Act.
9. Cookies and tracking
Our website uses cookies and similar technologies. They fall into a few groups:
• Necessary. Keeping your cart working, keeping you signed in and processing checkout. Our website will not function properly without them.
• Functional. Remembering your preferences and settings.
• Analytics. Measuring how the site is used, including session recordings that show how visitors move through pages.
• Advertising. Supporting our advertising and measuring whether it works, including identifiers shared with advertising platforms.
You may control cookies through your browser settings. Blocking analytics and advertising technologies will not prevent you from purchasing from us; blocking necessary cookies will, however, prevent checkout from operating.
10. Keeping information secure
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These include access controls, secure hosting and agreements with our service providers.
If we become aware of an eligible data breach that is likely to result in serious harm, we will, as soon as practicable, notify affected individuals and the Office of the Australian Information Commissioner ("OAIC") as required by the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act.
11. How long we keep it
We keep personal information only as long as we need it for the purposes described in this policy, or as long as the law requires. Order and financial records are kept for at least five years, as required by section 262A of the Income Tax Assessment Act 1936 (Cth), and for seven years where required by section 286 of the Corporations Act 2001 (Cth).
We do not retain all personal information associated with an order merely because part of the transaction record must be kept. Marketing records are kept until you opt out, and suppression records are kept afterwards so that we continue to honour your choice. When we no longer need information we destroy it or de-identify it.
12. Accessing and correcting your information
You may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Email our Privacy Officer at sales@justprotools.com.au. We will respond within 30 days of receiving your request. We may need to verify your identity before we can act on a request. We do not charge you for making a request, and we do not charge for correcting your information. We may charge a reasonable amount for giving you access, which will not be excessive. If we refuse access or refuse to correct information, we will give you a written notice setting out our reasons and the mechanisms available to you to complain about the refusal.
13. Complaints
If you think we have breached the APPs, contact our Privacy Officer, Katrina Paras, at sales@justprotools.com.au or on (02) 4721 7970. Please provide sufficient detail to enable us to investigate the matter. We may need to verify your identity and ask you for further information before we investigate. We will acknowledge your complaint promptly and respond within 30 days of receiving it.
If you are not satisfied with our response, you may complain to the OAIC at www.oaic.gov.au, by phone on 1300 363 992, or by writing to GPO Box 5288, Sydney NSW 2001.
14. Automated decision-making
Our ecommerce platform automatically assesses each order for signs of fraud and gives it a risk score and a recommendation. The kinds of personal information used in that assessment include your name, email address, delivery and billing address, payment method details, IP address and device information, and your order history with us.
The kinds of decisions this assists with are whether to accept, hold or cancel an order. That assessment is a recommendation only. It does not, of itself, cancel, refuse or hold an order. A member of our team reviews any order that is flagged and decides what to do, and you can contact us if you believe an order has been declined in error.
We do not make any decision that could reasonably be expected to significantly affect your rights or interests solely by automated means.
15. Changes to this policy
We may update this policy from time to time. The current version is always published at justprotools.com.au and applies from the date it is published. Where a change means we will use or disclose your personal information in a materially different way, we will notify you where required to do so by law.
